Paper Trail Is Best Malpractice Claim Defense

   When a client makes a malpractice claim, the best (and often only) defense is the contents of your file!

   We recommend you document all consequential advise in a letter to the client, particularly when the client indicates he/she intends to take a course of action different from what you recommended. Ask your client to sign all settlement offer rejections.

   Be sure to send and keep copies of all letters of engagement, non-engagement and disengagement and fee agreements, as well as any changes to the above.

   Less important matters should be noted in memos to the file.
